If a Muslim girl is 16 years old then she can marry of her own free will. This decision of the single judge bench of Punjab and Haryana High Court has come. The High Court said that the marriage of Muslims is subject to Muslim personal law. Under this, someone who attains sexual maturity is considered eligible for marriage. The Muslim couple, who had married without the consent of the family members, had applied in the High Court for their safety. The High Court ordered the police to provide necessary security to the 16-year-old girl to live with her husband.
A bench of Justice Jasjit Singh Bedi passed the order while disposing of the security petition of the Muslim couple. According to the petitioner, the marriage of both took place on June 8. Both married according to Muslim customs. The counsel for the petitioner argued that under the Muslim Personal Law, a Muslim boy or girl who becomes young is free to marry of her own free will. In this case, there is no interference of the parents.
The bench of Justice Jasjit Singh Bedi has ordered the SSP in this matter to take a decision on the relevant demand letter as per the law. It is necessary to resolve the doubts of the petitioner and the court cannot turn a blind eye.
The petition seeking equalization of age of marriage is pending in the Supreme Court. Be it a boy or a girl, a request has been made to make the minimum age of marriage 21 years. The minimum age of marriage should be uniform and gender neutral, i.e. the minimum age of marriage for all citizens of the country should be 21 years.
